Sexual Assaults and Alcohol – Know the Law

• An incapacitated person does not forfeit his/her rights.
• When someone is drunk, he or she is judged as unable to give consent.
• If you have sex with someone who is passed out or incapable of giving consent, it is sexual assault.
• Sexual assault is a serious crime; felony charges, expensive legal fees, and prison sentences are predictable outcomes.
• Using alcohol or other date rate drugs (e.g., rohypnol or GHB) to facilitate a sexual assault increases criminal consequences.
